1) Scope and acceptance
These Terms of Use (“Terms”) govern your access to and use of the Platform, including all pages, listing profiles, rating displays, and any related tools (search, filters, claim forms, review features).
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
2) What the Platform is (and is not)
RatEx42 Listings is a directory and intelligence-oriented listing platform for cyberfinance-related entities (e.g., payment processors, gateways, on-ramps/off-ramps, VASPs/CASPs, EMIs/PIs, and other service providers).
The Platform may include:
- Listing profiles created by RatEx42 and/or provided/updated by third parties;
- Editorial indicators (e.g., risk signals, evidence grades, verification badges);
- User-generated content, such as reviews/ratings and comments (where enabled);
- Links to third-party websites and sources.
Important: RatEx42 is not a regulator, law firm, auditor, or financial advisor. The Platform does not provide legal, investment, tax, or compliance advice, and does not offer regulated financial services.
3) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to submit reviews, claim a listing, or otherwise contribute content.
4) Definitions (plain-English)
- “Listing”: a profile page about an entity or service provider.
- “Verified” badge: a status indicating that a listing has been claimed and we have completed a limited verification process (see Section 8).
- “Editorial content”: RatEx42’s written text, indicators, risk signals, evidence grades, summaries, and similar material.
- “User Content”: reviews, comments, submissions, suggested edits, uploaded materials, or other content submitted by users.
5) Listings: accuracy, updates, and non-endorsement
Listings may be compiled from public sources, user submissions, and/or information provided by the listed entity or its representatives.
While we aim for accuracy, you acknowledge that:
- listings can be incomplete, outdated, or disputed;
- we do not guarantee that any listing is error-free;
- inclusion of any entity does not mean endorsement, approval, affiliation, licensing, or compliance.
You are responsible for your own due diligence before using any third-party service referenced on the Platform.
6) Editorial risk signals, evidence grades, and methodology
The Platform may display editorial indicators such as risk signals (e.g., green/orange/red/black), evidence grades, and other classification tags.
These indicators:
- reflect RatEx42’s opinion based on the information available at the time of review;
- may be updated without notice as new information emerges;
- do not represent a definitive finding of fact or a determination by any authority;
- should not be used as the sole basis for decisions.
Where available, RatEx42 may publish a methodology page describing general criteria and definitions. However, methodology descriptions do not create any warranty or guarantee.
7) User reviews and star ratings
Where enabled, users may submit reviews and star ratings. You acknowledge that:
- user reviews are opinions of the reviewers, not RatEx42;
- reviewers may have different experiences, incentives, or biases;
- star ratings are not an official compliance rating and may not correlate with editorial indicators.
Review rules
By submitting a review, you agree that it must be:
- truthful to the best of your knowledge;
- based on real experience or verifiable interaction;
- respectful, non-defamatory, and non-harassing;
- free of illegal content, hate speech, threats, doxxing, or personal data of third parties;
- not promotional spam or undisclosed advertising/affiliate content.
We may (but are not obliged to) moderate, edit for clarity/length, hide, or remove User Content at our discretion, including where we believe it violates these Terms or creates legal risk.
8) “Verified” badge: what it means
A “Verified” badge indicates that a listing has been claimed and that we have performed limited checks which may include some or all of:
- verifying control of a domain/email associated with the entity;
- confirming representative status via documentation or other signals;
- validating certain submitted details against public records.
A Verified badge does NOT mean:
- the entity is licensed, regulated, compliant, solvent, safe, or recommended;
- RatEx42 audited the entity or verified every statement on the listing;
- any regulator has approved the entity.
We may remove or change verification status at any time, including if evidence suggests misrepresentation or if verification becomes stale.
9) Claiming a listing and submitting updates
If you claim a listing or submit edits:
- you represent that you are authorized to act for the entity (or have a legitimate interest and are truthful);
- you agree to provide accurate, non-misleading information;
- you agree not to use the claim process to suppress criticism or manipulate ratings.
We may request additional information and may reject claims or edits for any reason, including where we cannot reasonably validate them.
10) Acceptable use
You agree not to:
- misuse the Platform for fraud, impersonation, harassment, or unlawful activity;
- interfere with the Platform’s operation (e.g., scraping beyond reasonable limits, attacking, probing, or circumventing security);
- upload malware or attempt unauthorized access;
- submit content that infringes intellectual property, privacy, or other rights;
- post personal data about individuals (addresses, phone numbers, IDs) without a lawful basis and consent.
We may rate-limit, block, or ban users/IPs where we suspect abuse.
11) Intellectual property
The Platform, including its design, structure, editorial content, and branding, is owned by RatEx42 and protected by intellectual property laws.
You may view and share links to public pages for informational purposes, but you may not reproduce, republish, or commercially exploit our editorial content without permission, except where allowed by law.
User Content remains owned by its submitter, but by submitting it you grant RatEx42 a worldwide, royalty-free, non-exclusive license to use, display, reproduce, modify (for formatting/moderation), distribute, and translate it in connection with operating and promoting the Platform.
12) Third-party links and services
The Platform may link to third-party websites. We do not control these sites and are not responsible for their content, availability, or practices. Access them at your own risk.
13) No warranties
To the fullest extent permitted by law, the Platform is provided “as is” and “as available.” We make no warranties, express or implied, including fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability.
14) Limitation of liability
To the fullest extent permitted by law, RatEx42 will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of (or inability to use) the Platform.
If liability cannot be excluded, RatEx42’s total liability for any claim will be limited to the minimum amount required by applicable law (whichever is higher).
15) Indemnification
You agree to indemnify and hold RatEx42 harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- your breach of these Terms;
- your User Content;
- your misuse of the Platform;
- your violation of any law or rights of a third party.
16) Suspension and termination
We may suspend or terminate access to the Platform (or remove content) at any time, with or without notice, if we believe you violated these Terms or pose legal/security risk.
17) Complaints, corrections, and disputes about listings
We aim to handle correction requests responsibly. If you believe a listing contains material inaccuracies, you can contact us at: corrections@ratex42.com.
Depending on the case, we may:
- request evidence or documentation;
- publish a correction, update, or clarification;
- decline to change content where we consider it opinion-based, supported, or unresolved.
18) Privacy and cookies
Your use of the Platform is also governed by our Privacy Policy.
19) Changes to these Terms
We may update these Terms from time to time. The “Effective date” will change when we do. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
20) Governing law and jurisdiction
These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the courts of Delawre, unless mandatory consumer protections apply.
